Terms and conditions

Welcome to Acomply. These terms govern the use of the platform. By creating an account or booking through acomply.co you accept these terms. If you don't agree, don't use the service.

1. What Acomply is

Acomply is a software platform (SaaS) that lets barbershops, hair salons, spas, nail studios, massage centers, aesthetic clinics, and other personal-service businesses in Colombia offer online bookings, communicate with their customers over WhatsApp, run marketing campaigns with artificial intelligence, and accept payments through Wompi. Acomply is not a service business; it's the tool these businesses use to operate.

2. Who can use the service

There are two types of users and the terms apply to both:

  • Businesses and their team ("Customer"): whoever signs up for the subscription and uses the platform to manage their business.
  • End customers ("Visitor"): whoever books an appointment through acomply.co/{business} or interacts with the WhatsApp assistant.

You must be over 14. If you are a minor, you need authorization from your legal guardian.

3. Account and registration

  • The information you provide must be truthful and current.
  • You are responsible for keeping your credentials secure and for all activity carried out from your account.
  • If you are a business, you are responsible for the behavior of your team members on the platform.
  • You can close your account at any time by writing to us at hola@acomply.co.

4. Subscription, packs, and payments (business Customer only)

  • The subscription is billed monthly in Colombian pesos (COP). The current plans are Esencial ($49.900), Maestro ($79.900), and Élite ($99.900). The current price and inclusions are shown at the time of signing up.
  • Each plan includes a monthly allowance of WhatsApp messages and AI generations. When the allowance is reached, sending is blocked until the start of the next period or until you buy a top-up pack.
  • Top-up packs are charged as one-time purchases and are applied immediately to the current month's allowance. They do not expire within the current month.
  • Payments are processed through Wompi (Bancolombia). Acomply does not store card information; we only receive the status of the transaction.
  • If your payment fails and isn't resolved within 7 days, we may suspend access to the platform. Your data is kept for 12 months during the suspension.

5. Online payments for appointments (between Visitor and business)

Some businesses enable online payment for appointments via Wompi. In those cases, the payment goes to the business's merchant account, not to Acomply. The business is responsible for the service provided, any refunds, and invoicing. Acomply only acts as the software provider that connects the business with Wompi.

6. How bookings work (Visitor)

  • You choose service, professional, date, and time within the business's available hours.
  • The appointment is confirmed when you receive the confirmation message via WhatsApp or email.
  • We will send you a reminder approximately 24 hours in advance.
  • Prices shown are indicative. The final amount may vary based on the service actually delivered and is confirmed at the location.
  • You can reschedule or cancel with at least 2 hours' notice. Late cancellations or repeated no-shows can lead the business to require prior confirmation or a deposit on future bookings.

7. AI assistants (Receptionist, Marketing, Analytics)

  • The conversational assistant uses artificial-intelligence models to understand your messages. Conversations are kept to improve the service and to support handling of complaints. You can request their deletion at any time.
  • The marketing image generator produces pieces based on the business's information. Generated images are indicative: they may contain style variations between generations.
  • The analytics assistant responds with real data from your account. It does not make up numbers — if it doesn't know something, it tells you.
  • Acomply does not guarantee the accuracy of the assistant's responses or simulations. Any decision about your appointment should be confirmed with the business.

8. Expected conduct

When using Acomply you agree not to:

  • Book under a false identity or using someone else's WhatsApp numbers.
  • Make mass bookings with the intent to block out time slots.
  • Send offensive, illegal, non-consensual sexual, or off-topic content to the assistant.
  • Upload photos of third parties without their permission to the simulators.
  • Attempt to breach, probe, reverse-engineer, or destabilize the platform.
  • Use the service to send spam or unsolicited messages to customers.
  • Attempt to access data from other businesses or their customers.

We may suspend or cancel accounts that break these rules, without refund of the current month's subscription if the violation is serious.

9. Business Customer data

As a business Customer, the end-customer data you enter into the platform is yours. Acomply processes it exclusively on your instruction to provide you with the service (see Privacy policy). If you cancel your account, we can delete it at your request or hand it over to you in exportable format within 30 days.

10. Intellectual property

Acomply's name, logo, code, designs, and content are ours or licensed to us. You may not copy, redistribute, or develop derivative products without written permission. The brand and content uploaded by each business remain the business's property.

11. Availability and limitation of liability

We make reasonable efforts to keep the service available, but it is offered "as is" and "as available". We don't guarantee uninterrupted availability or that the service will be free of errors. We are not responsible for:

  • Interruptions caused by external providers (Meta, Vercel, Neon, Wompi, OpenAI, Google).
  • Lost appointments, revenue, or customers resulting from technical failures.
  • Errors in messages generated by the artificial-intelligence assistants.
  • Indirect, consequential, or lost-profit damages.
  • Decisions made solely on the basis of assistant information without confirming with the business.

In any case, Acomply's aggregate liability to the business Customer is limited to the amount paid for the subscription in the 3 months preceding the event that gave rise to the claim.

12. Cancellation and termination

  • You can cancel your subscription at any time from your account settings or by writing to us. Cancellation takes effect at the end of the billed period.
  • We may terminate your account with 30 days' notice if we stop operating the service.
  • We may suspend or terminate your account without notice for serious breach of these terms, fraud, or illegal use of the service.

13. Changes to the terms

We may update these terms. When we do, we will change the date at the top and, if the changes are significant, we will let you know by email at least 15 days in advance. If you keep using the service after the effective date, you are deemed to accept the new terms.

14. Governing law and jurisdiction

These terms are governed by the laws of the Republic of Colombia. Any dispute will be resolved before the civil courts of the defendant's domicile, except where mandatory law provides otherwise.
